PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE INSTRUCTING SUPREME SAFARIS LIMITED TO ORGANISE A SAFARI FOR YOU. ANY FAILURE ON YOUR PART TO COMPLY WITH THESE TERMS AND CONDITIONS MAY LEAD TO THE CANCELLATION OF YOUR SAFARI AND WITHDRAWAL OF THE SERVICES OFFERED BY SUPREME SAFARIS LIMITED.
The following terms and conditions (“Terms and Conditions”) govern your access and use of this website (“Site”) and the content and services offered to you through this Site. It is a condition of booking a safari through Supreme Safaris Limited (“Supreme Safaris”) that these Terms and Conditions are accepted in full.
These Terms and Conditions together with the accepted quotation contain all the terms and conditions of the agreement between the parties (the “Agreement”). The parties acknowledge that there are no understandings, representations or terms between them, save for those as set out in the Agreement.
Supreme Safaris reserves the right to vary these Terms and Conditions at any time by placing the revised Terms and Conditions on its website www.supremesafarisafrica.com and you will be deemed to have been bound by such variation by continuing to use the services. You (the “Client”) should periodically check the website to make yourself aware of any variations.
Payment
The Client will be required to make an advance payment (the “Advance Payment”) to Supreme Safaris Client Account at the time of booking to secure the underlying reservations. The Advance Payment shall be of 25% of the estimated total cost of the safari. The balance of the payment is to be paid to the Supreme Safaris Client Account at least six (6) weeks before the date of the commencement of the safari (the “Safari Start Date”). Depending on the circumstances and nature of the underlying reservations, Supreme Safaris reserves the right, solely at its own discretion, to demand a greater amount as an Advance Payment. If a booking is made less than six (6) weeks to the Safari Start Date, the whole amount Is payable to the Supreme Safaris Client Account at the time of the confirmation of the booking.
Client Account
Funds received in the Supreme Safaris Client Account remain the property of the Client until they are committed by Supreme Safaris towards the reservations the Client has asked Supreme Safaris to make.
Cancellation Policy
All cancellations must be made in writing to Supreme Safaris by e-mail. Supreme Safaris will not take any responsibility for extra services which the Client will have made directly.
In the event of Cancellation, the Client’s recovery is restricted to any uncommitted funds in the Supreme Safaris Client Account. In such circumstances, Supreme Safaris reserves the right to charge a 10% commission.
Rates
The quoted cost of the safari is the price per person either sharing or in a single room. The safari includes the services and provisions as stated in the correspondence between Supreme Safaris Limited and the clients. Prices are subject to change without notice, for example in the event of Government action or any other circumstances beyond the control of Supreme Safaris Limited.
Supreme Safaris’ Responsibility
Supreme Safaris, is responsible for making the arrangements for the tour offered. Supreme Safaris acts only as an agent for the tour participants in all matters connected with the tour transportation, hotel, dining services, sightseeing tours and other services in connection with any itinerary.
It is important to note that all bookings with Supreme Safaris are subject to the terms and conditions and limitations of liability imposed by transport service providers, hoteliers and other service providers whose services are utilized, and some of which limit or exclude liability in respect of death, personal injury, delay and loss or damage of baggage.
Whereas due care will be exercised in the selection of reputable transport service providers, hotels and other suppliers of the various travel services used in the safari, Supreme Safaris does not and will not assume any liability whatsoever for any injury, damage, loss, accident or delay to person or property due to any act of default of any hotel, transport service provider, restaurant, company or person of any of the servants or agents rendering any of the services included in the tour.
Supreme Safaris will not accept responsibility for any damage or delay due to sickness, pilferage, labour disputes, machinery breakdown, quarantine, and government restraints. Supreme Safaris will not accept responsibility in contract or in tort for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force majeure or other events which is beyond Supreme Safaris’ control, or which are not preventable by reasonable diligence on the part of Supreme Safaris, including but not limited to war, civil disturbance, fire, flood, unusually severe weather, acts of God, acts of Government or any other authorities, accidents to, or failure of machinery or equipment or industrial action (whether or not involving our employees and even though such actions may be settled by acceding to the demands of a labour group).
Supreme Safaris reserves the right to cancel or change itineraries or substitute services without notice and to decline to accept or retain any clients at any time. No carrier shall be responsible for any act, omission or event during the time passengers are not on board its own conveyance.
Client’s Responsibility
The Client should familiarize himself with any health or visa requirements that may be applicable in the areas that he intends to visit. The Client shall be responsible for all entry, exit, health and any other documents required by law, regulations, orders, demands or requirements of the places visited or transited. Passport, visa and vaccination requirements are not the responsibility of Supreme Safaris and Supreme Safaris shall not be liable for any loss or expense due to the Client’s failure to comply with the above. It shall be the Client’s responsibility to obtain any appropriate insurance in order and to meet any additional costs incurred as a result of failure to comply with such requirements. The Client accepts that he may be travelling through areas of political, climatic instability, high altitudes and remote areas without proper medical services, and accept the associated risks. The making of a booking constitutes the Client’s acceptance of all booking terms and conditions as described herein and forms the basis of your contract with Supreme Safaris.
Confidentiality
Supreme Safaris undertakes to take all reasonable and necessary steps to protect the confidential information of Clients.
The Client hereby authorises the Company to electronically record and store the following information: -
The Client authorises Supreme Safaris to use the aforementioned information for the following purposes:-
General
If any provision of this Agreement is found by a court of law to be invalid or void, such provision will be severed from the remaining provisions, without effecting the remainder of the agreement hereof.
No delay in the enforcement of any right of any party arising from this agreement will in any circumstances be construed as implied consent or election by such party or operate as a waiver or novation of, or otherwise affect any parties’ rights in terms of this agreement.
The Client shall not be entitled to cede any of its rights or assign any of its obligations under this Agreement. If Supreme Safaris institutes any legal proceedings against the Client to enforce any of its rights under this agreement, it shall be entitled to recover from the Client all legal costs that it incurs to its own attorneys on an attorney/own client basis, including but not limited to collection commission and tracing agent charges.
The construction, validity and performance of these terms and conditions shall be governed in all respects by the Laws of Kenya.
